Legal Researcher Post (Racial Discrimination + Litigation Cost Analysis)

I am seeking a detail-oriented legal researcher with experience in California civil rights law, public accommodation law, and racial discrimination cases. The goal is to identify precedent, damages trends, potential litigation costs, and previous enforcement actions or settlements to support negotiation strategy for a potential settlement. The focus is on situations where a property owner may be held liable for racial discrimination or unlawful conduct committed by a contractor operating on their property. The researcher will also identify legal theories and strategies used to establish property owner liability in these situations.
Scope of Work:
1. Case Precedent Research (Racial Discrimination Focus)
• Identify California cases involving racial discrimination in public accommodations, including malls, retail centers, parking facilities, or other commercial properties.
• Focus on incidents where the property owner may be held liable for actions of a contractor or employee working on their behalf.
• Document key information:
• Case name, court, year
• Facts and actions of property owner and contractor
• Legal claims raised, such as Unruh Civil Rights Act, Bane Act, and premises liability for discrimination
• Outcomes, damages awarded including statutory, compensatory, and punitive damages, and attorney fees
2. Property Owner Liability Research
• Identify legal theories, strategies, and mechanisms used to hold property owners liable for contractor misconduct, including but not limited to:
• Premises liability and non-delegable duties
• Vicarious liability / respondeat superior applications
• Negligent hiring, supervision, or retention claims
• Statutory obligations under California civil rights laws (Unruh Act, Bane Act)
• Provide examples or case references demonstrating how courts have applied these theories to hold property owners accountable
3. Previous Settlements and Enforcement Actions
• Search for **previous settlements or enforcement actions** related to racial discrimination or similar claims involving the property owner or the contractor.
• Include:
• Settlement amounts or judgments
• Nature of the claims
• Agencies involved or courts where cases were filed
• Summarize how these past settlements may influence the company’s potential liability or negotiation strategy
4. Leverage Analysis
• Identify patterns and leverage points, including:
• How discrimination claims influenced settlements or judgments
• Cases where prior discrimination claims increased liability in subsequent incidents
• How indemnity agreements or contracts affected property owner liability for contractor misconduct
5. Litigation Cost and Risk Analysis
• Research the companies involved, including the property owner and the contractor, to identify:
• Their in-house legal teams or outside counsel
• Typical hourly rates for attorneys in this type of litigation
• Historical trial duration for similar California civil rights, premises liability, or discrimination cases
• Provide estimated financial exposure for taking the case to trial, including:
• Litigation costs for the companies, including attorney fees, expert witnesses, and court fees
• Estimated time and complexity of trial
Deliverables:
• Annotated case list with citations, facts, outcomes, and relevance
• Summary report highlighting trends, leverage points, and potential negotiation impact
• List of legal theories and mechanisms for holding property owners liable
• Compilation of previous settlements or enforcement actions relevant to the property owner or contractor
• Litigation cost estimates and trial duration analysis per company
• Optional commentary on how precedent, legal strategies, and potential costs strengthen settlement leverage
Skills Required:
• Familiarity with California civil rights law including Unruh Act and Bane Act
• Experience with racial discrimination case research and trial outcome analysis
• Knowledge of premises liability and property owner liability for contractor misconduct
• Ability to identify legal theories and mechanisms for holding property owners liable
• Ability to search for and summarize previous settlements or enforcement actions
• Ability to estimate litigation costs and trial timelines
• Strong attention to detail and ability to summarize complex data clearly
